Terms and Conditions
I. The parties to the contract
The seller (thechemistetal.com) and the natural or legal person who opens an account or places an order through our store, hereinafter referred to as the buyer.
II. Availability
Product availability is displayed correctly and in real time. However, there is a possibility that in the case of choosing a product with limited stock, until the order is completed, it will be ordered by another buyer. In this case we will contact you without fail to solve the problem.
III. Product description and pictures
Through the description and pictures of the products, we try to reflect the reality as best as possible and they are correct at the time of display in the online store. The colors of the pictures vary depending on the settings of the monitor or screen used. Please keep this in mind when selecting colors.
Product descriptions are provided by manufacturers and due to the large volume of information only partially verified by us. If you discover an oversight or notice that any information is incorrect, please do not hesitate to contact us to help us verify and correct any problem found.
IV. Price
The price of the products does not include the cost of shipping to the buyer. Also, the price of products may change when restocking, due to normal market fluctuations. This means that if you find yourself in the case of point II, where the site has allowed you to order a product while the stock is limited, we cannot guarantee you the originally displayed selling price as the new price may be different, but this may be even more big and small.
V. Payment
We try to offer as many modern payment systems as possible. The goal is to make them safe and user-friendly for the buyer. You can pay using your credit/debit card through the secure Netopia platform, by bank transfer to our IBAN account or cash on delivery directly to the courier.
The products remain the property of the seller until the full payment of the invoice.
VI. Access to the online platform
Access to the online platform is free and open. We reserve the right to prevent access to those who do not use it for the purpose for which it was created (placing online orders) as well as to customers who have refused to pick up their orders until the costs related to the transport of the refused parcels have been paid.
VII. Dispatch
Since the products are present in the store’s stock, the shipment will be made in most cases by the end of the next business day at the latest. We ship the products quickly, in a maximum of 5 working days. We use this longer term for busy periods such as before or after the holidays, when order volume can increase significantly.
VIII. Delivery
For delivery we use the services offered by courier companies. Delivery times are generally 1 working day from the time of dispatch but may increase during holidays or when weather conditions are unfavorable. The cost of delivery is automatically calculated at checkout, for each of the couriers available for the delivery address. If the delivery address is outside the couriers’ coverage area, they may charge an additional delivery fee. In this case we will contact you to confirm the new delivery cost or to choose to pick up the order from a regional delivery center of the chosen courier.
IX. Returns
You have the right to return the product (or products) within 14 days of receipt. To return, please open a return request directly on our website. Choose the order that contains the product or products to be returned, check the product to be returned as well as the quantity and then confirm the opening of the return request. After you receive our confirmation, pack the products properly then print and attach the return form before shipping.
Some products cannot be returned and will be clearly marked on our website. This includes customized products on demand, single-use products if they have been unsealed, etc.
The buyer is responsible for the return costs and for the safety of the products until they reach us. We are not responsible for the integrity of the products during return if they have not been properly packaged by the buyer.
After receiving the return, if the product is in the same condition as when we shipped it, we will refund the price paid for the product. The price of the initial transport to the customer cannot be returned as it is not a service offered by our company.
If the condition of the products is different from that at the time of dispatch by us and it is possible that this can be rectified, we will charge a minimum cost for these operations. cost that will be presented to the customer for accepting the reconditioning of the products or declining the reconditioning and shipping back to the customer.
The return of products in good condition and unused does not attract any additional cost, the full price of the product being returned to the customer. We reserve the right to offer free reconditioning of the returned product, subject to spare parts availability and spare time. The cost of shipping back to the customer, for products that could not be returned, is charged additionally or they can be shipped together with a subsequent order.
X. Warranties
The products are covered by the warranty of conformity for 2 years from the date of purchase. This means that the product is guaranteed against any hidden defect due to a manufacturing fault. This warranty does not cover defects caused by improper, non-specification or non-intended use of the product.
Products that additionally benefit from a commercial guarantee, if applicable, will have its duration specified on the presentation page of each product.
XII. RGPD
We use your personal data strictly for the purpose of fulfilling the contractual obligations arising from placing an online order. They will be used to send you information regarding the placed order, to issue the invoice as well as to ship the order.
In the normal course of the performance of the contract, personal data are transmitted:
- payment processor (in the EU)
- of the outsourced accounting service (in Cyprus)
- courier service (in Cyprus)
The terms of processing (storage) of personal data are:
- data related to the online account: 1 year from the last access/order
- data from issued invoices: 10 years starting from the year immediately following the one in which the document was issued (in accordance with the legal regulations in force)
Access to personal data is done by logging into the online account where they can be viewed or rectified directly. For deletion, restriction of processing, opposition to processing and obtaining them in a portable electronic format, please access online the dedicated RGDP menu in the customer account. Please note that data from issued invoices cannot be deleted or anonymized before the legal retention period expires.
The supervisory authority to which you can file a complaint regarding the processing of personal data is: dataprotection.gov.cy
We also want to inform you that we do NOT operate any automated decision-making process based on customers’ personal data.
XIII. Other
This contract is considered read, known, signed and assumed by both parties when you open your online account and when placing each new order.
